Pleitear contra el señor del castillo y bajo su jurisdicción: resistencias de los campesinos catalanes frente a la servidumbre de las obras de "Castell termenat" (siglos XIV-XV)

    La actitud de los habitantes de los señoríos rurales en la Cataluña del siglo  y principios del  frente a la obligación de participar en las obras de reconstrucción o forticación del castillo, ilustra un caso insólito de resistencia u oposición colectiva a un derecho señorial. Los campesinos catalanes que, por lo general, no manifestaron oposición a satisfacer al señor del castillo las rentas agropecuarias jadas por la costumbre territorial, opusieron una feroz y tenaz resistencia a cumplir con una servidumbre personal que consideraban injusta y odiosa por los enormes sacricios y perjuicios económicos que les causaba. Pleiteando colectivamente contra el señor del castillo, las comunidades rurales supieron sacar partido de la propia jurisdicción señorial en la que se dirimieron las causas en favor de sus intereses, poniendo en evidencia los grandes vacíos legales que presentaba el Derecho de castell termenat, levantado por los juristas catalanes sobre la base de la conmemoración Si qui alodiarii de Pere Albert, sobre el que los señores fundamentaban sus exigencias.

    e attitude of the inhabitants of rural lordships in Catalonia in the fourteenth century and the early years of the fteenth century regarding the obligation to participate in the reconstruction or reinforcement of the castle illustrates an unusual case of collective resistance or opposition to a seigniorial right. Catalan peasants, who usually did not question the agricultural rents due to the lord of the castle that were xed by local customs, ercely and stubbornly resisted a personal servitude which they considered unjust and odious, as a result of the enormous sacrices and economic harm it caused. Litigating collectively against the lord of the castle, rural communities were able to take advantage of the same seigniorial jurisdiction in favor of their own interests. In the process, they highlighted the legal weaknesses presented by the right of castell termenat, which Catalan jurists based on Pere Albert�s commemoratio Si qui alodiarii, and upon which the lords of the castle based their demand for free peasant labor.
