Un paso más hacia la conciliación familiar en la nueva regulación laboral del personal al servicio del hogar

    El nuevo régimen del servicio del hogar familiar ha supuesto, después de 25 años de una normativa precaria, un primer avance en garantías y derechos para el/la trabajador/a, dando paso a una contratación más segura, mejor informada y que supone una mejora en relación a la mujer, a la conciliación de familia y trabajo, también en los momentos de crisis que estamos atravesando.

    Bien es cierto que la especialidad de la relación hace que sea una regulación que conjugue el mantenimiento de las diferencias donde tienen su justificación objetiva y razonable, con la reducción o eliminación de las mismas cuando sea posible su equiparación progresiva a la relación laboral común. En este contexto, se pretende hacer un análisis de la especialidad de la relación laboral, destacando las novedades reguladas por el RD 1620/2011, tendentes a la conciliación con la vida familiar.

    The new regime of the service of the familiar home in Spain has supposed, after 25 years of a precarious regulation, the first advance in guarantees and rights for the worker, giving to a surer, better informed contracting and that supposes an improvement in relation to the woman, to the conciliation of family and work, also in these moments of economic crisis that we are crossing. Well it is true that the speciality of the relation brings the maintenance of the differences where they have reasonable justification, with the reduction or elimination of the same ones when the progressive comparison is possible to the labor common relation. In this context, this article tries to do an analysis of the speciality of the labor relation -service of the familiar home-, emphasizing the innovations of RD 1620/2011, tending to the conciliation with the familiar life.
