    El autor plantea en este trabajo la necesidad de introducir criterios de certidumbre en la aplicación de la teoría de la pérdida de oportunidad, ya que de lo contrario se corre el riesgo de generar una espiral de reclamaciones constantes en el ámbito sanitario pasando de la noción de una obligación de medios a una obligación de resultados.     In this article, the author introduces the need for certainty criteria in the application of the theory of loss of opportunity because otherwise the risk arises of creating a spiral of constant claims in the healthcare system, and of a shift from the notion that the system has an obligation to provide means and facilities to a notion that it has an obligation to provide results. The author pleads for the introduction in the legal system of criteria that, without prejudice to the courts’ appreciations, allow a more precise delineation of the probability parameters that lead to the determination of responsibility of the Health Authorities.
