Resumen de Implicaciones de la Justicia victimal en el Derecho Penitenciario

  La reparación victimológica no debe considerarse un cuerpo extraño en el derecho penitenciario, antes al contrario, debe entenderse como una parte esencial del cumplimiento de la sanción penal impuesta.

  Las víctimas deben ser las protagonistas centrales del proceso de ejecución penal para conseguir la reeducación y reinserción social de los penados No cabe realizar un pronóstico favorable de comportamiento inicial y futuro del interno si no existe una modifi cación de su actitud ante el delito, o lo que es lo mismo ante la víctima. Podemos afi rmar, que sin la intervención de la víctima en la ejecución penal no es posible el objetivo resocializador del delincuente.

  Victim�s wounds repair is not expected to be a strange area in penitentiary law. Otherwise it has to be thought as an essential part of the sentence or a humanitary part of the punishment. Victims are the cornerstone of the criminal prosecution in order to get inmates reeducation and reinsertion. It is not possible to set up a future forecast in positive if it is not observed a behavior modifi cation to repair the victim. We can state that the victim participation is the only way to get the reeducation goal for the crime author.

  La réparation victimologique ne devrait pas être considérée comme un corps étranger dans la Loi pénitentiaire, tout au contraire elle doit être entendue comme une partie essentielle de l�application de la sanction pénale infl igée. Les victimes doivent être les protagonistes essentielles du processus d�exécution pénale pour obtenir la réhabilitation et la réinsertion sociale des détenus. Si le détenu ne change pas son attitude face au crime, ou face à la victime, il ne faut pas réaliser un pronostic favorable de comportement initial et à venir de l�infracteur. Nous pouvons affi rmer que l�objectif de resocialisation du délinquant n�est pas possible sans la participation de la victime dans le processus d�exécution pénale.

  konponketa biktimologikoa ez da gorputz arrotz baten gisa hartu behar zigor-zuzenbidean (lehen, alderantziz); aldiz, ezarritako zigorra betetzearen funtsezko zati gisa ulertu behar da. Zigor-gauzatzearen prozesuan protagonista nagusiak biktimek izan behar dute, zigortuak berreztea eta birgizarteratzea lortzeko.

  Ezin da egin presoaren hasierako eta etorkizuneko jokamoldearen aldeko iragarpenik, hark ez badu bere jarrera aldatu delituarekiko, edo, bestela esanda, biktimarekiko. Baieztatu daiteke zigor-gauzatzean biktimak parte hartu gabe, ezin dela bete delitugilea birgizarteratzeko helburua.
