    Aborda la problemática competencial que se suscitó a partir de 1996 entre la Suprema Corte de Justicia de la Nación y el Tribunal Electoral del Poder Judicial de la Federación en cuanto al control de constitucionalidad en materia electoral. Se considera que la reforma de 2007 al artículo 99 constitucional no fue suficiente para resolver tal conflicto, por lo cual se analizan dos alternativas de solución: el fortalecimiento del Tribunal Constitucional Electoral, así como la proyección federal de la figura de una Sala Constitucional- Electoral, recientemente creada por el H. Congreso del Estado de Nayarit como parte del Poder Judicial de esa entidad federativa.

    Speak on the competential problematic that was raised since 1996 between the Supreme Court of Justice of the Nation and the Electoral Court of the Judicial Power of the Federation regarding the control of constitutionality in electoral matter are reviewed here. It is considered that the reform of 2007 to the 99 constitutional article was not sufficient to solve that conflict, so two alternatives of solution are analyzed: 1) the strengthening of the constitutional electoral court; and 2) the projection in the federal level of the figure of a constitutional electoral chamber, recently created by the Congress of Nayarit State as a part of the judicial power of this federal entity.
