    A proteção aos direitos humanos tem apresentado uma evolução constante, principalmente após a Segunda Guerra Mundial, haja vista que foi precisamente nessa época que esse ramo do direito começou a se positivar, sendo criados, em nível regional, instituições e tribunais para a resolução dos conflitos relacionados com a violação dos direitos humanos. Além disso, começa a surgir uma aceitação entre os Estados no que diz respeito à implementação das diretrizes jurídicas internacionais em seus respectivos direitos internos, especialmente no nível constitucional, ao mesmo tempo em que têm sido criados outros organismos internos com a finalidade de proteger, em nível nacional, o indivíduo como ser humano. Verifica-se, pois, que existe responsabilidade, tanto no âmbito internacional como no âmbito interno, para a proteção aos direitos humanos, criando-se uma simbiose jurídica de proteção dos direitos em ambos os planos com o objetivo único de proteger o ser humano como indivíduo.

    The protection of human rights has made steady progress, especially after the Second World War, given that it was precisely at this time that this branch of law began to make positive strides, with institutions and courts being created at the regional level for the resolution of conflicts regarding the violation of human rights. Moreover, there has been a growing acceptance among the states regarding the implementation of international legal guidelines into their respective domestic laws, especially at the constitutional level, at the same time other domestic agencies have been created in order to protect the individual as a human being at the national level. There is, therefore, a responsibility that exists within both the international and domestic scope to protect human rights, creating a legal symbiosis of protection of these rights in both levels with the sole purpose of protecting the individual human being.
