La responsabilidad profesional médica civil es la obligación de reparar los daños y perjuicios causados al paciente por una conducta ilícita o por la creación de un riesgo. Cuando el daño es ocasionado por una acción que carece de la intención concreta de dañar y no es culpa o negligencia inexcusable del paciente, se habla de responsabilidad objetiva, ya que la profesión médica implica el uso de mecanismos, instrumentos, aparatos o substancias peligrosas por sí mismos.
La responsabilidad civil se refiere también a bienes inmateriales como son el honor, sentimientos, afectos o reputación, cuyo daño causado es en el ámbito de lo moral por ser derechos de la personalidad.
No se trata de causar en los médicos una situación de terror que les inhiba en el ejercicio del servicio que prestan, sino simplemente en crearle conciencia legal de lo delicado y trascendental que puede ser el uso y manejo de las substancias o instrumentos que le son necesarias para la obtención o recuperación de la salud de sus pacientes, pues el tener vocación para ejercer tan honrosa profesión lo debe sensibilizar de las consecuencias legales que implica un error médico.

The civil liability also refers to immaterial goods as they are the honor, feelings, affections or reputation, whose as personality rights, cause damage in the moral environment of the thing to be right of the personality.
This article not wants to produce a fear-situation in physicians that inhibits them in the exercise of the service that they lend. It�s intention is improve their legal conscience about how delicate that can be the careless use and handling of the substances or instruments that are necessary for obtaining or recovering their patient�s health, because having vocation to exert so honorable profession must sensitize them of the legal consequences that a medical error implies.
