    This article intends to insert Jeremy Bentham in the process of the philosophers� ascension, during the so-called "Age of Enlightenment" (the 18th century) in the discussion of penal matters, a trace of which is recognizable in determinate discourse representations that created a differentiated place in relation to the traditional common law, which, according to him, concealed its errors through an aura of mystery and depth, in a head-on clash with legal order utopia and absolutely clear knowledge.

    Finally, the postscript presents a comparison between Bentham and Arturo Rocco�s still-current concept on the relationship between juridical and non-juridical knowledge.

    Neste artigo pretende-se inserir Jeremy Bentham no processo de ascensão dos filósofos durante o chamado "Século das Luzes" (século XVIII) na discussão dos problemas penais, traço identificável em determinada impostação do discurso que cria para si um lugar diferenciado em relação ao discurso jurídico tradicional. Em Bentham, essa postura tomou a forma de forte polêmica contra a tradicional common law que, segundo ele, seria um discurso que teria escondido seus erros em uma aura de mistério e profundidade, em choque frontal com sua utopia de uma ordem legal e de um conhecimento absolutamente transparentes. Por fim, o pós-escrito esboça uma comparação entre Bentham e a concepção ainda atual de Arturo Rocco sobre a relação entre o saber jurídico e o não-jurídico.
