Resumen de Judicial review of competition decisions under the European Convention on Human Rights and the importance of the EFTA Court: the Norway Post Judgment

John Temple Lang

  • In the Norway Post judgment, the EFTA Court built on the jurisprudence of the European Court of Human Rights and the European Court of Justice and explained comprehensively the principles relevant to judicial review of competition authorities' decisions under art.6 of the European Convention on Human Rights. The EFTA Court's clear and concise judgments are playing a leading role in strengthening the judicial dialogue between the European Courts and helping to create a seamless body of European law on judicial review, which applies to judgments of national courts in all States that are members of the Council of Europe, as well as to the EU and EFTA Courts.
