En este trabajo realizo una crítica teórica a las relaciones contractuales entre el Estado y los altos directivos administrativos del Poder Ejecutivo, que constituye uno de los componentes del paradigma de la Nueva Gestión Pública. Sostengo que las relaciones contractuales en la forma específica que propone el NGP en su modelo ideal tipo es funcional al ideal tipo de Estado Neoliberal porque debilita el poder del gobierno representativo, y con ello el poder de la democracia y del centro estatal sobre el aparato administrativo estatal. Esto a su vez reduce la autonomía del Estado con respecto al mercado y su enraizamiento con las masas ciudadanas. Inversamente, las relaciones contractuales de tipo NGP fortalecen el poder de la tecnocracia, fortalecen su enraizamiento con el mercado y el capital privado, y fortalecen su autonomía con respecto al gobierno representativo, el proceso democrático y las masas ciudadanas.

The aim of this work is to make a theoretical critique to the introduction of contractual relations between the State and the senior managers of the Executive branch which is one component of the New Public Management (NPM) paradigm. I assert that the contractual relationships in the specific form proposed by the NPM in its ideal-type model is functional with the ideal neoliberal State-type, because it weakens the power of the representative government, and thus the power of democracy and the State center over the administrative apparatus. As a consequence, this weakens the State's autonomy with respect to the market and weakens its rooting with people. Inversely, they strengthen the power of a technocracy, they strengthen its rooting with the market and the private sector, and they strengthen their autonomy with respect to the representative government, the democratic process and the citizens.
