    While 2008 was characterised by stagnation in the field of constitutional legislation, 2009 has brought about some constitutional and legislative reforms as well as events that are important for the constitutional practice. The year which is being analysed, has been that of the continuation of the difficult political cohabitation between a President coming from the Law and Justice Party (Conservative), Mr. Lech Kaczyn'ski, and the government of Mr. Donald Tusk, leader of the Civic Platform (Liberal) who had formed a coalition government with the Polish People's Party. The elections to the European Parliament have undoubtedly constituted the most important political and constitutional event in Poland in 2009. In the very rich Polish constitutional case law, it has to be noted, first of all, the first substantive decision settling a jurisdictional dispute between the Prime Minister and the Head of State regarding the representation of Poland in the European Council.

    Alors que l'année 2008 était celle d'une stagnation dans le domaine de la législation en droit constitutionnel, l'année 2009 a apporté certaines réformes constitutionnelles et législatives ainsi que des événements importants pour la pratique institutionnelle. L'année analysée a connu la poursuite de la cohabitation politique difficile entre un Président issu du parti Droit et justice (conservateur), M. Lech Kaczyn'ski, et le gouvernement de M. Donald Tusk, leader de la Plateforme Civique (libéral) qui avait formé une coalition gouvernementale avec le Parti paysan polonais. L'élection au Parlement européen a constitué sans aucun doute l'événement politique et constitutionnel majeur en Pologne en 2009. Dans la très riche jurisprudence constitutionnelle polonaise, il faut noter avant tout la première décision de fond tranchant un conflit de compétence, conflit entre le chef du gouvernement et le chef de l'Etat concernant la représentation de la Pologne au Conseil européen.
