    Loyalty to the principles of the British parliamentary system has long delayed the advent of modern constitutionalism in Australia. In the recent period, the High Court has significantly contributed to the development of constitutional norms and to the protection of rights and liberties. It has, thus, shaped an original form of the rule of law, which combines the British notion of the rule of law to American constitutionalism.

    L’attachement aux principes du parlementarisme britannique a longtemps retardé l’avènement d’un constitutionnalisme moderne en Australie. La Haute Cour a, dans la période contemporaine, contribué de manière significative aux développements de la norme constitutionnelle et à la protection des droits et libertés. Elle a ainsi façonné un État de droit original, mêlant rule of law britannique et constitutionnalisme américain.
