La idea de pacto social en Chile. Hacia los albores de un pacto y de una nueva Constitución.

    El presente artículo tiene por objetivo constatar la presencia del contrato o pacto social como artefacto conceptual en la historia constitucional chilena, y respecto de algunos hitos producidos en la historia política chilena. Para ello, luego de revisar algunas precisiones modernas en torno al concepto de contrato o pacto social, se adopta uno propio, a través del cual posibilitar dichos análisis. La relación analítica entre pacto social y constitución, se verifica en el artículo teniendo como base fundamental los preámbulos de las Constituciones Políticas en Chile, considerados como discursos, y que por ende implican ser un texto con significado, de cuya interpretación se ocupará el artículo en cuestión, sin perjuicio de considerar otros discursos, tales como los declarados por la institucionalidad política. Las prácticas analizadas, serán especialmente las prácticas políticas institucionales que tuvieron lugar en la historia política chilena, y que se pueden leer como hitos históricos, a la luz de los cuales analizar metodológicamente desde el concepto de pacto social.

    The objective of this article is to verify the existence of the social contract or pact as conceptual artefact in the history of the Chilean constitution, used in certain milestones in the Chilean political history. In order to do this, a new concept of social contract is developed based on the modern conception of social contracts, which makes possible the analysis of this paper. The analytical relationship between social pact and Constitution is verified base on the preambles of the Political Constitution of Chile. These are considers as discourses, therefore it implies a text with meaning, of which interpretation is analysed in this article, however, it does not ignoring the consideration of other discourses, such as the one declared in the political institution. The practices examined here are the institutional political practices that have been taking place in the history of the Chilean politics, and can equally be considered as historical milestones. These are then evaluated methodologically with the prism of a social pact concept.
