Resumen de Proceso y justicia de transición: ¿búsqueda por una "justicia" o traer el ejemplo do qué no debemos hacer "nunca más"?

  This study aims to establish the limits and search for a transitional justice, the idea is, after so many years, there still exists some legal significance in determining past events from other times. What is the reason of a whole study, a complete canvass to find proofs and collecting testimonials from those who suffered the agression? The victims, these people who have suffered or had losses during the dictatorship, does justice reaches them? Has judging an elderly military, as happened with Pinochet, brought any relevance to the victims? Perhaps for the society. The focus of the research is understanding wich is the major reason for creating a proceeding, and a transitional justice. When such effort is implemented and a trial is made, when all the truth is discovered, we look back and remember those who gave their lives by not agreeing with the regime, others who died because they were considered terrorists, tortures, and so on. We seek one justice that may not reach us or we seek to understand the past to avoid commit ting the same mistake in the future.

  o presente trabalho busca estabelecer os limites e buscas de uma justiça de transição, a ideia é, depois de tantos anos, ainda existe alguma relevância jurídica em apurar fatos passados de outros tempos. Qual o motivo de todo um estudo, de toda uma apuração para encontrar provas, colher depoimento de quem sofreu as agressões. As vítimas, essas pessoas que sofreram ou que tiveram perdas com os tempos de ditadura, a justiça lhes alcança? Julgar um militar já em idade avançada como foi o caso de Pinochet, trouxe alguma relevância para as vítimas? Para a sociedade talvez. O foco da pesquisa é entender qual o motivo maior de se criar um processo, e uma justiça de transição. Quando tal empenho se concretiza e se tem um julgamento, quando se descobre toda a verdade. Olhamos para traz e lembramos aqueles que deram suas vidas por não concordar com o regime, outros que morreram por que eram considerados terroristas, torturas, e etc. Buscamos uma justiça que talvez não nos alcance ou buscamos entender nosso passado para não repetir tal equívoco no futuro.
