El Ejecutivo carece de facultad constitucional para regular el arbitramento y para señalar tarifas al arbitramento independiente

    Durante el año 2007, el Gobierno colombiano reglamentó, a través del Ministerio del Interior, el procedimiento arbitral institucional y sus tarifas mediante los decretos 3626 de septiembre y 4089 de octubre de ese año. Estas normas no deben extenderse al arbitramento independiente, ya que este último tiene como fuente exclusiva a la voluntad contractual. Este artículo se referirá de manera sucinta a tres aspectos que deben aclararse para evitar equívocos. En primer lugar, la facultad que tiene o no tiene el Ejecutivo para reglamentar el arbitraje. En segundo lugar, la posibilidad que tiene o no tiene el Congreso de la República para delegar en el Ejecutivo la facultad de legislar sobre arbitramento, mediante la aprobación de facultades extraordinarias. Finalmente, la aplicación de estos decretos, mientras gozan de presunción de legalidad, al arbitramento voluntario e independiente.

    In 2007, the Colombian government regulated, through the Ministry of the Interior, the procedure and fees for institutional arbitration through decrees 3626 and 4089 of September and October of that year. These regulations should not extend to independent arbitration, since the exclusive source for that type of arbitration is the will of the parties to a contract. This article will refer briefly to three aspects that should be clarified in order to avoid misunderstandings. First, whether the president has a right to regulate arbitration. Secondly, whether Congress can delegate to the executive the power to legislate on arbitration through extraordinary powers. Finally, the application of these decrees, as they are presumed legal, to voluntary and independent arbitration.
