El régimen de sostenibilidad medioambiental

    Una de las partes esenciales de la concepción del desarrollo sostenible es su variable ambiental. La Ley de Economía Sostenible de 2011, aunque en algunos supuestos se aparte de esa concepción y la utilice de una forma muy amplia, incluye naturalmente un Título en la materia, regulando algunos aspectos de la sostenibilidad medioambiental, pero, lejos de establecer una regulación general en la materia, únicamente prevé disposiciones aisladas en materia de energía (energías renovables y ahorro y eficiencia energética), de reducción de emisiones (a la atmósfera exclusivamente), sobre transporte y movilidad sostenible y finalmente en materia de rehabilitación y vivienda. Disposiciones que se analizan en este trabajo, previo un análisis del concepto del desarrollo sostenible, en el ámbito europeo y su plasmación en España.

    One of the essential parts of the concept of sustainable development is its environmental variable. Although the Sustainable Economy Act of 2011, in some aspects, does not fit this conception, using it in the widest sense, it does naturally include a Title on the subject, regulating some aspects of environmental sustainability. However, far from establishing a general regulation on the subject, it only foresees isolated dispositions concerning energy (renewable energies and energy savings and efficiency), emissions reductions (solely into the atmosphere), sustainable mobility and transport and, finally, housing and rehabilitation. Such dispositions, following a concept analysis of sustainable development, are analyzed in this work in the European sphere and in their application to Spain.
