El autor analiza la comparecencia del procurador y de la parte material en la fase procesal de audiencia previa al juicio. En primer lugar se hace un breve recorrido sobre la finalidad de la audiencia previa en el proceso civil, interpretando el contenido previsto en el artículo 414.2 de la LEC, sobre el régimen de la comparecencia del procurador y las partes en la fase de audiencia previa. En el presente trabajo, el autor defiende la idea de que la representación mediante procurador en sede de audiencia previa no es preceptiva. Finalmente, se analiza el papel del procurador en el proceso civil, y las funciones que este tiene a la luz de la nueva Ley 13/2009 de la Oficina Judicial.

The author analyzes the appearance of the agent of court and the trial phase material in the stage of preliminary hearing. First, a brief tour of the purpose of the stage preliminary hearing in the civil process, interpreting the contents provided for in Article 414.2 of the LEC, on the arrangements of the hearing the agent of court at the stage preliminary hearing. In this paper, the author argues that agent court representation by the seat of a prior hearing is not mandatory.
Finally, we analyze the role of the agent of court in a civil proceeding, and the functions that this is in the light of the new Law 13/2009 of the Judicial Office.
