    La excepción preliminar de falta de agotamiento de recursos internos, ha sido la más incoada por los Estados Parte en los diferentes procesos contenciosos ante el Sistema Interamericano de protección de Derechos Humanos.

    Es por lo anterior que nace el interrogante ¿la excepción falta de agotamiento de recursos internos es un mecanismo de defensa estatal efectivo? Sin embargo, se evidencia en el seno de la Corte Interamericana de Derechos Humanos, que de forma sistemática, la excepción es desestimada tornándola no efectiva para las pretensiones estatales.

    The preliminary objection for lack of exhaustion of domestic resources, has been the most filed by the States Party to the various contentious proceedings before the Inter-American system of protection of Human Rights.
