    El que se ha dado en llamar neoconstitucionalismo latinoamericano se vincula a las experiencias constitucionales acontecidas desde la década de los noventa del pasado siglo. Éstas coinciden, con fórmulas plurales, en rescatar la cláusula de Estado social y desde ella construyen un constitucionalismo económico innovador. Tanto la constitución ecuatoriana como la boliviana, que representan el último momento constitucional, introducen modelos singulares. Sin violentar ninguna interpretación del estado social, acentúan el espacio público en el sistema económico, asentando su preeminencia sobre el mercado. Igualmente, introducen una regulación constitucional, verdadera novedad, del sistema financiero funcionalizado al sostén del desarrollo económico.

    The so called latin american neoconstitutionalism is linked to the constitutional experiences that have taken place from the nineties of the last century. They coincide whit plural formulae in rescuing the social State clause and based on it they build up an innovative eonomic constitution. Both, the Ecuatorian and the Bolivian constitution, which mean the last constitutional moment, introduce singular models. Whithout forcing any interpretation of the social State, they emphasize the public space in the economic sistem, sitting down its preeminence over the market. Likewise, they introduce a constitutional regulation of the financial sistem, which is a real innovation, functionalized to support the economic develooment.
