La víctima de la violencia de género y la dispensa del artículo 416 de la LECrim

    La Ley Orgánica 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género (LOMPIVG) coloca a la denuncia de la víctima como uno de los pilares del proceso de género, por ser la principal fuente de conocimiento de la notitia criminis; pero la realidad judicial es que muchas veces, tras ser presentada la denuncia y puesto en marcha el procedimiento judicial, ésta se retrae de su primera declaración en el acto plenario del juicio oral. Entra aquí en aplicación el artículo 416.1 de la LECrim, y surge la cuestión doctrinal y jurisprudencial de si la víctima de violencia de género, tras haber sido ella quien da inicio al procedimiento judicial con la interposición de la denuncia, puede ampararse en la dispensa de la obligación de declarar o si dicha excepción al deber de declarar ha de ser modificada legislativamente para evitarlo.

    The Organic Law 1/2004 of December 28th, concerning Integral Protection Measures against Domestic Violence (LOMPIVG), makes the victim�s report one of the pillars of the process, as it is the principal source of knowledge of �notitia criminis�. However, the reality is often that, after the supposed crime has been reported to the authorities and the judicial procedure has been set in motion, the victim changes their first declaration during the oral trial. Here, article 416.1 of the LECrim has to be applied, and there arises the doctrinal and jurisprudential question of whether the victim of domestic violence, after having initiated the judicial procedure on the interposition of the report to the authorities, can seek protection in the exemption from the obligation to declare, or whether the above mentioned exemption must be modified in the legislation for this to be avoided it.
