  • Eight years after the events of 11 September 2001, the war on terror continues in many parts of the world. However, the expression war on terror as such, has lost much of its currency this is so mainly for political reasons, but this evolution revives the debate on how to characterize, as a legal matter, the fight against terrorism. Following an examination of the pros and cons of the war on terror, this comment examines the position of international law on this issue. It concludes that the same fundamental principles apply regardless of the expression used and the legal system governing the fight against terrorism.
