Los deberes constitucionales en el Derecho comparado

    En este estudio el autor destaca el renacido interés por el tema de los deberes constitucionales, ignorado tradicionalmente en relación con los derechos fundamentales.

    Tres parecen ser, según el autor, las razones de este relativo cambio de tendencia:

    la pulsión hacia el universalismo de los derechos, que ha conllevado el replanteamiento de algunos aspectos de la cultura jurídica y política de origen eurocéntrico;

    las exigencias del desarrollo sostenible con respecto a las generaciones futuras; la debilidad que está afectando al Estado social contemporáneo globalizado. Tras un análisis sintético de los deberes constitucionales en las varias formas de Estado y formas de gobierno tanto desde una perspectiva diacrónica como desde una perspectiva sincrónica, el autor pone de relieve la necesidad pero también la dificultad, en el mundo internacionalizado y globalizado de reafirmar con un enfoque homogéneo y coherente los derechos y los deberes del individuo en el ámbito de una Comunidad que esté al servicio de la promoción del mismo a fin de no acabar en el relativismo absoluto.

    In this study the author shows the resurgent interest in the subject of constitutional duties, traditionally ignored with regard to fundamental rights. According to the author, three seem to be the reasons of this relative change in this trend: the incentive to the universalism of rights that has determined the reconsideration of some aspects of the juridical and political culture of Eurocentric origin; the requirements of the sustainable development with regard to future generations; the weakness that is affecting the contemporary globalized welfare State. After a summary analysis of constitutional duties in different forms of State and regimes both a diachronic and a synchronic prospective, the author states the need but also the difficulty, in the internationalized and globalized world, to reaffirm, through an homogeneous and coherent approach, the rights and the duties of persons in the framework of a Community that it is at the service of promoting them with the purpose not to fall in the absolute relativism.
