    La libertad de testar, tal y como ha sido entendida en los diferentes territoriosde derecho vasco a lo largo de la historia, tiene por objeto la conservación del patrimonio familiar. Las reformas de los siglos XIX y XX en los territorios vascos ha acentuado, sobre todo en la Comunidad Autónoma Vasca, el reforzamiento de las instituciones tradicionales. El Anteproyecto del ley civil vasca de la AVD/ZEA rextiende la foralidad civil a todos los habitantes de la Comunidad Autónoma Vasca, regula la cuantía de la legítima sucesoria y recoge en su integridad los instrumentos típicos de la sucesión testada, sin olvidarse de la troncalidad, en la que introduce reformas fundamentales.

    Testamentary freedom, as it has been understood in the different areas of Basque law throughout history, is aimed at the preservation of family wealth. The amendments of the nineteenth and twentieth centuries in the Basque territories have underscored, especially in the Autonomous Community of the Basque Country, the consolidation of the traditional institutions. The AVD/ZEA�s Basque Civil Law Draft Bill puts forward once again the provincial civil law rights of all inhabitants of the Autonomous Community of the Basque Country, which regulates the amount of the legitimate inheritance and compiles in its entirety the typical instruments of testate succession, without forgetting birthright, wherein the fundamental amendments are introduced.

    Testamentua egiteko askatasuna ulertzen bada, euskal zuzenbidea zein lurraldek izan eta lurralde horietan historian zehar ulertu izan den moduan, askatasun horren xedea da familiaren ondarea iraunaraztea. XIX eta XX. mendeetan, zenbait eraldaketa gertatu ziren euskal lurraldeetan, eta, batik bat, Euskal Autonomia Erkidegoan; eraldaketa horiek indartu eta sendotu egin zituzten erakunde tradizionalak. Ildo beretik, Zuzenbidearen Euskal Akademiak Euskal Lege Zibilaren Aurreproiektua prestatu du, eta proiektu horrek forutasun zibila hedatzen die Euskal Autonomia Erkidegoko biztanle guztiei. Horrekin batera,proiektuak oinordetzako senipartearen zenbatekoa arautzen du, eta oso-osorik jasotzen ditu testamentuzko oinordetzaren ohiko tresnak, tronkalitatea ahantzi gabe, baina horretan oinarrizko eraldaketak eginez.
