La responsabilidad estatal en el actual Estado de Derecho

    Mientras que en el siglo XX se verificó una permanente extensión del campo de la responsabilidad estatal, en el siglo XXI se advierten síntomas de retroceso en el ámbito interno de los países (no así en el ámbito internacional) con detrimento de la calidad del Estado del Derecho.

    La observación de la realidad muestra que una de las causas de tal fenómeno es la migración de las Administraciones públicas hacia el Derecho privado, sea acudiendo a la regulación de su actividad por el mismo, sea a través de la constitución de figuras organizativas instrumentales de Derecho privado.

    Frente a ese panorama, desde el Derecho administrativo se impone la reafirmación de la responsabilidad estatal como principio general de Derecho, extendiendo su aplicación y acudiendo a nuevos medios -principiales, normativos y jurisprudenciales- para hacerla efectiva.

    While the Twentieth century verify a permanent extension of the states liability, the Twenty-first century notices symptoms of decline i the national field (but not in the international one) with detriment of the quality of the State of Right.

    Reality shows that one of the causes of this phenomenon is the migration of public administrations into the field of the private law, either through their own regulation of its activity or through the establishment pf private law instrumental organizations.

    Bearing in minds this background, from the Administrative Law perspective, there is a need to reassert the concept of state liability as a general principle of law, extending its application and turning to new means -principles, regulation and case law- to make ot effective.

    The quality of the State of Right depends, largely, on the state liability extension and on the effectiveness of the means to enforce it in a tmely and satisfactory way, taking into account the centrality of the human being and the consequent state serviceability.
