El Tribunal Constitucional ante las reformas estatutarias

    Las reformas de algunos Estatutos de Autonomía —de manera destacada, la del Estatuto de Cataluña, dado su contenido y alcance— han provocado el despliegue de todo tipo de recursos ante el Tribunal Constitucional. El análisis de la forma y manera en que se han planteado y cómo ha sido afrontada su tramitación y enjuiciamiento, evidencia que la entidad del problema ha resultado ser muy superior a la capacidad del actual Tribunal para solventarlo con rigor y prontitud. Tanto es así que, con independencia ya de cómo se resuelvan los recursos aún pendientes, no debería posponerse la adopción de todas aquellas medidas necesarias para corregir el deterioro y la grave crisis en la que, con ocasión de esas reformas estatutarias, definitivamente ha quedado inmerso el sistema de justicia constitucional.

    The reform of some Statutes of Autonomy —especially, the Statute of Autonomy of Catalonia, because of its content and its importance— has caused the deployment of every kind of appeal upon the Constitutional Court. The analysis of the ways and means in which those appeals have been filed and how their proceedings and judgements have been faced, shows that the magnitude of the problem has been much higher than the capacity of the present Court of solving it with rigor and promptness. Therefore, regardless of the way the appeals still pending are solved, it should not be postponed the adoption of those measures necessary to correct the damage and the serious crisis which, due to the said statutary reforms, have definitely affected the system of constitutional justice
