    Resumen: En el presente trabajo se aborda la problemática jurídico-científica en torno a la figura delictiva contemplada en el art. 159 del Código Penal, referente al delito de manipulación genética. Se trata de delimitar aspectos tales como el concepto jurídico de genes o de genotipo, así como determinar la importancia de la Ley 14/2007, sobre investigación biomédica, en el contexto de este precepto penal a la hora de considerar las conductas punibles.     Abstract: This paper addresses the legal-scientific issue arising from the offense referred to in the Article 159 of the Criminal Code, regarding the crime of genetic modification. It deals with delimiting aspects such as the legal concept of genes, or of genotype, as well as determining the meaning of the Law 14/2007, on biomedical research, in the background of this criminal dictate when considering the punishable behaviors.
