El texto refundido de la Ley del Suelo de 2008, ha dado una nueva redacción a la regulación de los derechos de retorno y realojo, que al suprimir el inciso inicial de la disposición adicional 4ª, hace desaparecer aparentemente toda referencia a la legislación básica de dichos derechos en nuestro ordenamiento jurídico. Se aborda la compleja evolución legislativa que se ha venido dando a los mismos en nuestro ordenamiento jurídico y la quiebra del sistema que supuso la Sentencia 61/1997, de 20 de marzo. Sobre la base de estos antecedentes y la configuración de los contenidos urbanísticos de la propiedad urbana se pretende dar una interpretación adecuada a la norma que permita definir la legislación básica de estos derechos.

The Land Law of 2008 has redrafted the settlement of rights of return and resettlement, deleting with it the initial point of the 4th additional provision, which contained the regulatory axis of this rights in Spanish legal system. Is provided to focus about existence of these rights in the new law, despite unfortunate legislative way and the system breakup, which involved the powers redistribution between the state and autonomous communities after STC 61/1997 of 20 March. Based on this background and configuration of urban property law, this work wills be attempt to perform a definition of the federal legislation scope respect in this area.
