    En esta investigación se analiza el requisito de identidad subjetiva del principio non bis in ídem. De esta forma se presenta las implicaciones derivadas de este elemento, los vacíos legales existentes en relación con las consecuencias que implican el respeto del postulado, y finalmente, se presenta una interpretación que, a nuestro juicio, podría ayudar a solucionar la laguna normativa existente.

    This research analyzes the requirement of subjective identity of the non bis in idem principle. This way the implications resulting from this element, the existing legal vacuums concerning the consequences the observance of this postulate and finally, an interpretation is presented, that to our knowledge maight help to solve the existing legal vacuum.
