    Históricamente, el bien jurídico ha tenido un protagonismo claro en la teoría del delito. Sin embargo, en los últimos años se ha venido planteado una crítica muy fuerte a este concepto, de tal manera que ha llegado a decirse que ha entrado en crisis. En este trabajo se analizan las perspectivas sustentadoras y críticas del bien jurídico, perfilándose su lugar en la teoría del delito del siglo XXI.

    Historically, the legal right has always played a first role in the offense theory. Nevertheless, recently, this concept has started being subject of strong critics, so that it is even said that it faces crisis. In this work, we analyze the perspectives that underpin and criticize the legal right, so that we can profile its place in the offense theory of the 21st Century.
