En este trabajo se aborda el estudio y análisis del recurso de amparo español buscando ilustrar al lector acerca de su configuración dentro del modelo constitucional y procesal español, asumiendo como orientación fundamental el estudio y análisis de las virtudes y problemas que se han evidenciado a lo largo de la vigencia de este mecanismo de tutela. En efecto, de competencia del Tribunal Constitucional, y recogido con carácter extraordinario y subsidiario de la tutela encomendada primariamente a los tribunales ordinarios de justicia, actualmente amenaza seria y progresivamente el trabajo del Tribunal, traduciéndose en una avalancha incontenible de recursos. Paradójicamente, como se verá en este trabajo, en la actual amenaza de colapso y desbordamiento del Tribunal mucho tendría que ver la actuación abierta y flexible del propio Tribunal Constitucional que, en su afán de consolidar el respeto por los derechos abrió demasiado la puerta de esta sede.
This paper addresses the study and analysis of the Spanish appeal for legal protection in order to illustrate its configuration in the constitutional and procedural Spanish model to the reader. This article is fundamentally orientated towards the study and analysis of virtues and problems that have appeared throughout the existence of this protection mechanism. Indeed, this mechanism of protection is capable of the Constitutional Court and has been drawn as extraordinary and subsidiary of the primary protection provided to regular courts. The excessive work of the Constitutional Court is currently seen as an uncontrollable rising of writs, which is increasingly jeopardizing the Constitutional Court work. Paradoxically, as we will see, the Constitutional Court has had much to do with the rising of the aforementioned risk as, in its eagerness to consolidate respect for the law, it opened the door to these headquarters too wide.
