    This article intends to investigate historical and cultural aspects of fundamental rights, in the perspective that defends the idea of a critical vision in its conception and in development of the theory. There is no intention like in law text compilations, being more a dialectic and historical reading of the doctrine of the fundamental rights, than properly or just a positive reading.

    O artigo busca tecer os aspectos históricos e culturais dos direitos fundamentais, na expectativa de propugnar uma visão crítica ao seu conceito e ao seu desenvolvimento teórico. Não tem, com isso, intenções que nos manuais de Direito são capitais, sendo mais uma leitura dialética e histórica da doutrina dos direitos fundamentais que propriamente ou apenas uma leitura dogmática positivista.
