  For the first time, the Constitution of the Fifth Republic has given a jurisdictional sanction to the respect of the constitutional bases of the legal rights of local authorities. But while the Constitutional Council has acquired this fundamental role, one may wonder what part it takes in the elaboration of such rights. It should be noted that while the principle of the free administration of local authorities emerges from these constitutional bases, it is not dominant. While it may limit the legislative branch, it cannot produce its own laws and define itself without reference to the general constitutional order, and the current growth of jurisprudence regarding the consequences of the indivisibility of the Republic and its corollaries imposes a certain legislative uniformity and limits the reach of this principle. However, to what extent does the acceleration of current changes, notably in the overseas territories, adapt itself to this general framework ?

  Pour la première fois, la Constitution de la Ve République attache une sanction juridictionnelle au respect des bases constitutionnelles du droit des collectivités locales. Mais en donnant ce rôle fondamental au Conseil constitutionnel, on peut se demander quelle part et quel sens prend son juge dans l’élaboration de la matière. Il faut observer que si le principe de libre administration des collectivités territoriales émerge de ces bases constitutionnelles, il ne les domine pas. Apte à limiter le pouvoir législatif, il ne peut néanmoins produire ses effets et se définir sans référence à l’ordre constitutionnel général, et l’essor actuel de la jurisprudence sur les conséquences de l’indivisibilité de la République et ses corollaires imposent une certaine uniformité législative et en limitent la portée. Mais jusqu’à quel point l’accélération des évolutions, notamment outre-mer, s’accommode-t-elle de cet ordre général ?
