Resumen de La reforma de la Ley Orgánica del Tribunal Constitucional y del Reglamento del Senado, puesta a prueba (SSTC 49/2008, de 9 de abril y 101/2008, de 24 de julio)

El artículo analiza las sentencias del Tribunal Constitucional que han resuelto los recursos de inconstitucionalidad contra las reformas de la Ley Orgánica de dicho Tribunal, y del Reglamento del Senado. Estas han venido a cambiar el sistema de elección de los magistrados del Tribunal Constitucional que propone el Senado, introduciendo la presentación de los mismos por las Asambleas Legislativas de las Comunidades Autónomas, y a prorrogar el mandato de la Presidencia de dicho órgano cuando el final del mismo no coincida con la periódica renovación del Tribunal. Tras exponer los argumentos que expresaron la mayoría de los magistrados, y los contenidos en los votos particulares a las correspondientes sentencias, el autor se pregunta tanto por las razones de fondo de las reformas, que determinaron el debate que se produjo, como por su verdadera efectividad, que parece más bien limitada.

The article deals with two decisions of the Constitutional Court of Spain, that has decided, in two constitutional appeals, in favour of the reforms of the organic Law of that Court, and the standing orders of the Senate, that have changed the way judges of the Constitutional Court, nominated by the Senate, are elected, introducing the proposal by the Legislative Assemblies of the Autonomous Communities, and have also extended the period of mandate of the President of the Court when the end of it does not take place at the same time that the periodical renewal of the Court. After making an exposition of the opinions of the judges, both majority an dissenting opinions, the author asks himself both about the real reasons of the reforms, that were decisive in the debate that took place in the Court, and their effectiveness, that appears as pretty limited.
