Constitución y extranjería: los derechos de los extranjeros no comunitarios en España

    El presente estudio tiene por objeto analizar cuál es el estatuto jurídico del extranjero en nuestro ordenamiento constitucional. Ello exige examinar el marco configurado por la Constitución española (artículos 13 y lo), los Tratados internacionales sobre la materia, la legislación específica de extranjería, esto es la LO 4/2000 modificada por la LO 8/2000, y la jurisprudencia del Tribunal Constitucional (especialmente SSTC 107/1984, 99/1985,115/1987,112/1991, 94/1993, 196/1993 y 95/2003). Esta última adquiere una importancia fundamental y ocupa por ello un lugar central en este estudio. Estudio que se divide en dos partes: en la primera, se expone el marco constitucional del régimen jurídico de los extranjeros tal y como ha sido interpretado por el Tribunal Constitucional; y, en la segunda, se aborda la regulación de los derechos y libertades de los extranjeros en la LOEx así como las garantías jurídicas de los mismos, y la conformidad o no de dicha regulación con la jurisprudencia constitucional.

    The present article tries to analyze which the alien juridical statute is in our constitutional law. It demands examine the mark configured by the Spanish Constitution (articles 13 and lo), the international Treaties on the matter, the specific legislation on alienage, this is the LO 4/200o modified by the 8/2000, and the Constitutional Court judgements (in particular 107/84, 99/85, 115 /87, 112/91, 94/93, 196/93 and 95/2003). This last one acquires a great importance and it occupies for it a central place in this study. This study is divided in two parts: in the first one, the constitutional mark of alien's juridical regime is exposed like it has been understood by the Constitutional Court; and secondly it's approached the regulation of the rights and privileges of aliens in the LOEx as well as the juridical guarantees of them, and the conformity or not of this regulation with the constitutional jurisprudence.
