La primera constitución española (1812) estableció en su artículo 12 la exclusividad religiosa del catolicismo en la nación española prohibiendo cualquier otra. Además, este mismo artículo atribuyó a las Cortes la facultad de protección de la religión católica. La historiografía liberal española se ha sentido tradicionalmente incómoda con el hecho de que el primer constitucionalismo fuera tan cerradamente intolerante, interpretándolo habitualmente como una necesaria concesión al sector más tradiciona-lista de las Cortes. Sin embargo, del estudio de los debates constituyentes, así como del análisis de la cultura político-religiosa de una parte significativa del primer liberalis-mo español pueden obtenerse respuestas más satisfactorias para explicar esta aparente contradicción.

The first Spanish constitution (1812) stated in article 12 that the Spanish nation was exclusively catholic not tolerating other confessions. In addition, the same article in-volved national legislature in the protection of the catholic religion. Spanish liberal his-toriography to the present time has certainly feel uncomfortable with the fact that the first Spanish constitutionalism and liberal discourse was closely intolerant, trying to ex-plain this fact as an almost necessary transaction with the traditionalist and monarchist wing of the Cortes (parliament). However, the study of the debates on the constitutional draft (1811-1812) and the analysis of the religious-political culture of a substantial part of the first Spanish liberalism allow us to explain this apparent contradiction between liberal constitutionalism and non-tolerant religious attitude.
