    • In the second half of the 19th century, the recently independent Latin American states started with the codification of their national laws. Whereas traditionally the investigation of this process has been focussed on the codification of civil law, depicting the image of a liberal spirit of the codification movement, the penal law codification has received less attention. A comparative analysis of the draft for an argentine penal law code from 1867, the later Código Penal from 1886, inc1uding the following debate between 1890 and 1920, and its model, the Bavarian penal law code from 1813, shows the predominance of a paternalistic approach towards criminality. Taking the European models as a reference, so as the legislators did, it is possible to draw a line of continuity between the thinking in the tradition of illuminated ideas of late absolutist penal law theories to interventionist thinking of the early 20th century.
