Resumen de El concepto de república en la Constitución Federal de los Estados Unidos Mexicanos de 1824: "Libertad en la Ley"

  • The question of federalism has been one of the most important problems which were discussed in the formulation of the Constitution of 1824. Historiography has analyzed this problem from different perspectives. However, the republican form of government was accepted without further comments, and was largely ignored by historiographers. In the present work, I'll retrieve the many meanings the protagonists gave to the concept of Republic by studying some discussions about the law, the division of powers and the metaphors of political embodiments. In this period, the Republic was meant to be not only the power of representation, but also a new form of creating laws, replacing the King as supreme legislator by the elected Congress. In any case, the legal regulations of the Ancient Regime continued to be used. Therefore, I'll study the influence of iusnaturalism and the classical tradition on those legislators who wrote and left their trace in the Constitution of 1824.
