    El reconeixement legal de les noves formes de religiositat [ALEX SEGLERS] La consolidació de noves i determinades formes de religiositat, en prendre una dimensió comunitària, semblen reclamar el reconeixement legal per part de l'Estat. Aquest nou repte sacseja el tradicional concepte juridic d'església, comunitat o confessió religiosa. L'article d'Alex Seglers, professor de dret eclesiàstic a ESADE, Universitat Ramon Llull, parteix de la premissa que, amb el canvi de segle, s'està accentuant una paradoxa de la societat contemporània: mentre d'una banda la ciència assoleix metes i cotes desconegudes, de l'altra cada vegada van sorgint més religions. Semblant disposició a la credulitat deixa sense vigência aquells auguris que sostenien un progressiu esvaniment del «sagrar». La immigració extracomunitària i l'existència de nous moviments religiosos palesen que el fenomen religiós acara tota mena de pronòstics. Certament, la dimensió religiosa segueix sense desaparèixer de l'esfera pública, més aviat va transformant-se... tot adoptant formes distintes de les tradicionais. El repte és evident: en aquest nou marc històric i plural, quin ha de ser el reconeixement legal de les noves formes de religiositat? L'autor contesta amb exemples rigorosos, propers i fefaents.

    The legal recognition of the new forms of religiousness [ÀLEX SEGLERS] The consolidation of new and specific forms of religiousness, on taking a community dimension, seem to claim legal recognition by the State. This new challenge jolts the traditional legal concept of church, community or religious confession. The article by Àlex Seglers, professor of Ecclesiastic Law of the ESADE, Universitat Ramon Llull, is based on the premise that a paradox of contemporary society has been accentuated on the change of century: while on the one hand science now either targets or actually reaches hitherto unknown goals, on the other, increasingly more religions are emerging. Such a disposal towards belief quashes predictions that had pointed to a progressive disappearance of things «sacred». Immigration from outside the EU and the existence of new religious movements make it clear that the religious phenomenon challenges all types of predictions. Certainly, the religious dimension has not yet disappeared from the public area, quite the opposite rather, as it is being transformed, taking on different forms other than the traditional ones. The challenge is a patent one, in this new historic and plural framework: how should the new forms of religiousness be legally recognised? The author answers with some rigorous, highly pertinent and reliable examples.
