Protección jurídica del discapacitado: en torno a la enfermedad mental

    Hacer converger a tres sectores que tienen en su mano la clave de la tutela como herramienta jurídica para darle la especial protección que requiere el discapacitado incapacitado civilmente: el Poder Judicial, la Administración Territorial y la Sociedad Civil; se convierte en el reto teórico-práctico cotidiano de la Fundación Tutelar FECLEM de personas con enfermedad mental en Castilla y León como Institución Tutelar.

    Desde esta Fundación Tutelar, como observatorio de las medidas leales, disposición de recursos e interlocutor del propio afectado, proponemos una aproximación a los conceptos de incapacidad y discapacidad y las figuras de protección y guarda. Un recorrido en el avance normativo y las formas de amparo que la sociedad ha ido desarrollando para la protección al más desfavorecido. Un marco jurídico-social para el desarrollo de acciones en defensa de los derechos civiles de las personas discapacitadas que repesentan además una merma en su capacidad de autogobierno determinada y garantizada "desde" y "por" nuestro ordenamiento jurídico.

    Hablamos de las personas más severamente afectadas por una discpacidad, las que no pueden representarse a sí mismas, ciudadanos "invisibles", desapercibidos en mejor de los casos. Aunque, y sobre todo, personas y por este hecho, con capacidad jurídica, con titularidad sobre sus derechos y obligaciones...

    The main current and daily challenge of the Tutlelar Foundation FECLEM, fully devoted to the mentally disabled, is based on the idea of making the three groups who are in charge of the tutelage as a legal procedure (the judiciary, the regional civil service and the very civil society) concur on the same strategy in order to provide the legally unprotected disabled handicapped with the appropriate protection and support.

    This Tutelar Foundation, observer of the concerning legal measures as well as the arrangement of the different resources, and legal delegate of the affected population, puts forward a closer approach both to the concepts of mental handicap and disability and the ideas of protection and custody; a step forward on current regulations and protection measures developed by society in order to defend the underprivileged; a proper legal and social context to develop appropriate actions to defend the civil rights of those mentally handicapped who actually show special difficulties in their capability for selfmanagement, capability which is determined and guaranteed "from" and "by" our current legislation.

    We are talking about those people who are most severely affected by a mental handicap, those who cant't manage to represent themseves, "invisible" citizens, unnoticed un most cases , but however, human people with legal capability and fair holders of theri rights and duties.
