El trabajo monográfico aborda, en el marco de las Garantías Constitucionales del proceso, el estudio de dos principios garantistas: Legalidad del Tribunal y Prohibición de Comisiones Especiales (Juez Natural); concluyendo que estas garantías tienen un contenido político y procesal que están en la raíz del Estado constitucional y, no obstante su filiación anglosajona, se han difundido ampliamente, difusión a la que contribuye, en el contexto continental, la jurisprudencia del sistema interamericano de protección de derechos humanos.
The monographic wok embraces, in the context of the constitutional Safeguards of the process, the research of to reassuring principles: The Legality of Law Court and the prohibition of Special Commissions (Natural Judge), concluding that these safe warranties have a political and legal content that lies on the roots of the Constitutional State. In spite of the Anglo-Saxon foliation, they have been widely spread out contributing, in the continental context, to the jurisprudence of the interamerican system of the defense of the human rights.
