The Advisory Opinion 32/25 of the Inter-American Court of Human Rights establishes two key elements for analyzing States’ obligations regarding climate mobility. The first is the ius cogens norm prohibiting irreparable harm to the climate and the environment, and the second is the recognition of the right to a healthy climate. This paper aims to propose the relationship between these two elements and climate mobility based on the review of conformity with treaties.

Therefore, it is essential to identify the content of the right to a healthy climate and to establish the scope of the review of conformity with treaties regarding climate mobility based on the general obligations of domestic law adaptation and non- discrimination arising from articles 1 and 2 of the American Convention on Human Rights.
