For decades now, Spanish Tax Authorities have been artificially increasing the tax revenues proceeding from immovable property acquisitions, by refusing to take into account the prize paid in the transaction. The explanation: the chronic sociological inclination of Spanish citizens to lie in legal deeds committing intellectual frauds in contractual documentation (only when VAT does not apply) and using dark money. Examining the data extracted from legal conflicts between taxpayers and a regional tax authority in Spain, Asturias, we can demonstrate beyond doubt that these explanations (all citizens lying all the time and laundering dark money at big scale) are not sustainable anymore, never were probably.

Lately, there’s always a hidden (or not so) pattern throughout history. Every time that Supreme Court or the Spanish Constitutional Court have ruled against the Tax Authorities or the Tax Law in relation with this particular abusive way of taxing the acquisition of property, the Law is changed to shirk those rules and restart a new regime with even less restrictions and more automatic. Again proving the absolute vulnerability of the Spanish citizens and the inexistent efficiency of the checks, if existent, over the attitudes and deviations of the Spanish Tax Authorities.
