      La inviolabilidad del domicilio (art. 18.2 CE) constituye uno de los derechos fundamentales que con mayor frecuencia entra en tensión con las necesidades de la investigación penal cuando la vivienda es compartida por una pluralidad de moradores. El presente trabajo analiza los criterios constitucionales y jurisprudenciales relativos a la validez del consentimiento prestado por uno solo de los cotitulares o convivientes para autorizar la entrada y registro domiciliario, distinguiendo la titularidad del derecho a la inviolabilidad domiciliaria —que corresponde individualmente a cada morador— de la facultad de autorizar la entrada, que puede ejercer cualquiera de ellos salvo que concurra un conflicto de intereses acreditado con el investigado. A tal efecto, se examinan los pronunciamientos más recientes de la Sala Segunda del Tribunal Supremo (2025-2026).

      Home inviolability (art. 18.2 of the Spanish Constitution) is one of the fundamental rights that most frequently comes into tension with the needs of criminal investigation when a dwelling is shared by several occupants. This paper analyses the constitutional and Supreme Court case law on the validity of consent given by only one of the co-owners or cohabitants to authorise entry into and search of the home, distinguishing between entitlement to the right to home inviolability —which belongs individually to each occupant— and the power to authorise entry, which may be exercised by any of them unless a proven conflict of interest with the person under investigation exists. To this end, the most recent rulings of the Second Chamber of the Supreme Court (2025-2026) are examined.
