La sentencia del Tribunal de Justicia de la Unión Europea de 30 de abril de 2026 (asunto C-133/24) analiza la compatibilidad con el artículo 101 TFUE de un acuerdo de no captación de jugadores adoptado por los clubes del fútbol profesional portugués y la Liga Portuguesa de Fútbol Profesional durante la pandemia de COVID-19. El trabajo examina los antecedentes del litigio, las conclusiones del Abogado General y la respuesta ofrecida por el Tribunal a las cuestiones prejudiciales planteadas, analizando, en particular, la noción de restricción de la competencia por el objeto, la incidencia de la jurisprudencia Meca-Medina y la relevancia que reviste el contexto económico y jurídico en que se adopta un determinado acuerdo a la hora de valorar si el mismo puede resultar contrario al derecho comunitario, prestando especial atención a la tensión existente entre la libertad de los clubes para competir en el mercado de contratación de jugadores y la necesidad de preservar la integridad y regularidad de las competiciones deportivas en situaciones excepcionales.
The judgment of the Court of Justice of the European Union of 30 April 2026 (Case C-133/24) examines the compatibility with Article 101 TFEU of a non-solicitation agreement adopted by Portuguese professional football clubs and the Portuguese Professional Football League during the COVID-19 pandemic. This paper examines the background to the dispute, the Advocate General’s Opinion and the Court’s response to the questions referred for a preliminary ruling, analyzing, in particular, the concept of a restriction of competition by object, the impact of the Meca-Medina case law, and the significance of the economic and legal context in which a particular agreement is adopted when assessing whether it may be contrary to EU law, paying particular attention to the tension between the clubs» freedom to compete in the player transfer market and the need to preserve the integrity and fairness of sporting competitions in exceptional circumstances.
