Supreme Court Judgments Nos. 1251/2026 of 18 March and 465/2026 of 17 April examine the scope of the administrative file as a safeguard of the tax liable party's rights of defence within the framework of Article 174.5 of the General Taxation Law (Ley General Tributaria, «LGT»). Both decisions are grounded in the settled case law recognising the secondary liable party's full rights to challenge the tax assessments and penalties constituting the basis of the derivative liability, while going a step further by clarifying the substantive content that must form part of the administrative file in order to ensure the effective observance of the adversarial principle. This paper argues that these judgments consolidate a substantive –rather than merely formal– conception of the administrative file, construing it as an indispensable prerequisite for the effective exercise of the tax liable party's rights of defence. In this regard, Judgment No. 1251/2026 reinforces the Administration's duty to incorporate the essential background materials of the audit and verification procedure underlying the derivative liability, whereas Judgment No. 465/2026 defines the limits of that obligation by excluding any unlimited reconstruction of the evidentiary chain or the submission of documents unrelated to the original proceedings. On the basis of a joint analysis of both decisions, the article contends that the Supreme Court is progressively shaping a jurisprudential model of procedural balance aimed at reconciling the effective protection of the tax liable party's rights of defence with the minimum requirements of evidentiary diligence and effective adversarial proceedings.
