These reflections concern what could be the fourth amendment to the 1978 Constitution. In this case, the amendment to Article 43 of the Spanish Constitution to guarantee women’s right to voluntary termination of pregnancy. These pages analyse the Government’s proposal in terms of its substantive content and its placement within Article 43 of the Spanish Constitution, which enshrines the right to health protection, highlighting the reasons for this placement and the possibility of extending the amendment to Article 53 of the Spanish Constitution in order to apply the enhanced guarantees recognised in that provision to the new text. The legal grounds of Constitutional Court Ruling 44/2023 of 9 May 2023 are also analysed, in particular the right to physical and moral integrity (Article 15 of the Spanish Constitution), and an alternative argument is put forward regarding the right to personal freedom (Article 17.1 of the Spanish Constitution) as a more appropriate constitutional basis for upholding the constitutionality of voluntary termination of pregnancy.
