A crise da modernidade: do constitucionalismo a transnacionalidade no estado contemporâneo

    The purpose of this paper is to present a reflection and analysis on the transformations of Constitutionalism up to the current Contemporary State, from a scenario of crisis of modernity. The research begins with a brief historical overview, and an approach to the definition and characteristics of the Rule of Law. In the sequence, the relativization of the traditional concept of Sovereignty is presented, as the supreme power of the State in face of Globalization, in a perspective that goes beyond the territorial delimitations of the State. Finally, a study of the Transnationality phenomenon is carried out in the face of social, political and economic transformations at the end of the20th century and the beginning of the 21st century, and its intrinsic relationship with the globalized world, in order to establish a world cooperation model for the development of a complex, cross-border and contemporary society, citing the InternationalCriminal Court as a positive example. In general, the article aims to expose the theme of Transnationality and its implications with Law, approaching the historical path of Constitutionalism, as well as the social impacts that Globalization presents for nation-states, especially for State Sovereignty. The study occurred through bibliographical research, having as methodological criterion used for this investigation, the Inductive Method.

    A finalidade deste trabalho é apresentar uma reflexão e análise sobre as transformações do Constitucionalismo até o atual Estado Contemporâneo, a partir de um cenário de crise da modernidade. A pesquisa tem início com breve histórico, e abordagem da definição e características do Estado de Direito. Na sequência, é apresentado sobre a relativização do conceito tradicional de Soberania, como poder supremo do Estado em face da Globalização, em uma perspectiva que vai além das delimitações territoriais do Estado. Por fim, é realizado um estudo do fenômeno da Transnacionalidade diante das transformações sociais, políticas e econômicas do fim do século XX e início do século XXI, e sua intrínseca relação com o mundo globalizado, no sentido de estabelecer um modelo de cooperação mundial para o desenvolvimento da sociedade complexa, transfronteiriça e contemporânea, citando como exemplo positivo o Tribunal Penal Internacional. De um modo geral, o artigo tem como objetivo expor sobre a temática da Transnacionalidade e suas implicações com o Direito, abordando o percurso histórico do Constitucionalismo, bem como os impactos sociais que a Globalização apresenta para os Estados-nação, em especial para a Soberania estatal. O estudo ocorreu através de pesquisa bibliográfica, tendo como critério metodológico utilizado para essa investigação, o Método Indutivo.
