O cyberbullying e o suicídio na sociedade líquida: a necessidade de uma revolução legislativa para o tratamento adequado das relações sociais online

    In this research, it was sought to do an analysis of cyberbullying and suicide of liquid-modern society, verifying the consequences of aggressions perpetrated under the aegis of freedom of expression through social networks on consciousness and individual behavior. Priority was given to a reflection of the way in which offenses can intensely affect the awareness of the social being in its individuality and of the role of the legal order as a factor for regulating relations. To this end, basic and explanatory research was carried out, using the deductive method based on current legislation, theses, dissertations, scientific articles and judicial decisions, as well as the collation of data that presented a gradual evolution of suicides in recent years. After an analysis of the theoretical set and the data collected, it was possible to find that today's society, made up of fragile relationships in its maintenance and conservation, can prevent suicidal practices by means of instruments that go beyond the positive legal norm, such as the search for the education of the collective conscience about the theme in order to prevent new cases. Finally, it was concluded that a recast of the current legal order is necessary to regulate the massive relationships of the networked society, as well as the need to implement new technologies aimed at keeping society informed about the theme with the purpose of preventing and avoiding new cases of cyberbulling.

    Nesta pesquisa, buscou-se fazer uma análise do cyberbullying e do suicídio da sociedade líquido-moderna, verificando as consequências das agressões perpetradas sob a égide da liberdade de expressão por meio das redes sociais na consciência e no comportamento individual. Priorizou-se uma reflexão do modo que as ofensas podem atingir de maneira intensa a consciência do ser social em sua individualidade e do papel do ordenamento jurídico enquanto fator de regulação das relações. Para tanto, realizou-se uma pesquisa básica e explicativa, utilizando-se o método dedutivo a partir da legislação vigente, teses, dissertações, artigos científicos e decisões judiciais, além do cotejamento de dados que apresentaram uma evolução gradual de suicídios nos últimos anos. Após análise do conjunto teórico e dos dados coletados, foi possível constatar que a sociedade atual, composta por relações frágeis em sua manutenção e conservação, pode prevenir práticas suicidas por meio de instrumentos que vão além da norma jurídica positivada, como a busca pela educação da consciência coletiva acerca do tema de modo a prevenir novos casos. Por fim, concluiu-se que é necessária uma reformulação do ordenamento jurídico atual para regular as relações massificadas da sociedade em rede, além de ser preciso implementar novas tecnologias que visem manter a sociedade informada sobre o tema com a finalidade de prevenir e evitar novos casos de cyberbulling.
