    Este artículo defiende que el derecho a una vivienda adecuada es un verdadero derecho que genera tanto deberes negativos como positivos para poderes públicos y particulares. Primero, se examina el marco constitucional e internacional que reconoce la exigibilidad del derecho a la vivienda. Luego, se aborda la relación teórica entre derechos y deberes, contrastando la visión formalista tradicional con enfoques contemporáneos que justifican la imposición de deberes en función de los derechos. A continuación, se exponen las bases filosóficas de los deberes positivos generales de ayuda al prójimo y su relevancia específica en materia de vivienda. Sobre esa base, el trabajo analiza las obligaciones jurídicas concretas (de respetar, proteger y proveer) vinculadas a este derecho y advierte sobre los límites que deben observarse al imponer deberes para no vulnerar la autonomía individual. En las conclusiones se subraya la necesidad de equilibrar solidaridad y libertad para hacer efectivo este derecho.

    This article argues that the right to adequate housing is a genuine right generating both negative and positive duties for public authorities and private actors. It begins by examining the constitutional and international framework that establishes the enforceability of the right to housing. It then addresses the theoretical relationship between rights and duties, contrasting the traditional formalist view with contemporary approaches that justify duties on basis of the rights. Next, the paper discusses the philosophical foundations of general positive duties to aid others and their specific relevance to housing. On that basis, the work analyses the concrete legal obligations (to respect, protect, and provide) tied to this right, and it cautions about the limits that must be observed when imposing duties so as not to undermine individual autonomy. In conclusion, the need to balance solidarity and freedom is underscored in order to effectively realize the right to housing.
