In its decision of 21 June 2024, docket No. 242.788-2023, the Supreme Court of Chile held that the healthcare provider has a duty to inform that becomes part of the contract through the principle of contractual good faith. This commentary examines both the sufficiency and the timing of that duty. It proposes orienting the duty to inform and informed consent toward the model of continuous consent. In line with Italian law, the duty to inform may be understood as a protective duty, which allows for a unified treatment of the private and public regimes of medical civil liability within the Chilean legal system. The ruling is also analyzed in relation to hypothetical informed consent in light of Chilean doctrinal positions.
